2. PRINCIPLES APPLIED TO DATA PROCESSING
In the processing of personal data, the Controller will apply the following principles in compliance with the GDPR:
Lawfulness, fairness, and transparency: Personal data will be processed lawfully, fairly, and transparently in relation to the User. The Controller will ensure that the processing is based on an appropriate legal basis and will provide clear and accessible information about its purposes before obtaining Users' consent, where necessary.
Purpose limitation: Personal data will be collected for specified, explicit, and legitimate purposes and will not be further processed in a manner incompatible with those purposes.
Data minimization: Only personal data that are adequate, relevant, and strictly necessary for the intended purposes will be collected.
Accuracy: Reasonable steps will be taken to ensure that personal data are accurate and kept up to date. Any inaccurate data will be rectified or deleted without delay.
Storage limitation: Personal data will be retained for as long as necessary to fulfill the purpose for which they were collected.
Integrity and confidentiality: Appropriate technical and organizational measures will be applied to ensure the security of personal data, protecting them against unauthorized or unlawful processing and against accidental loss, destruction, or damage.
3. PROCESSING OF PERSONAL DATA IN THE APP
3.1 Server Log Files
When you access the App, we automatically collect and process certain technical data necessary to ensure its proper operation. This data includes:
Model of the device used.
Session duration in the App.
IP address.
Date and time of access to the App.
Errors and technical failures detected during use.
This data is necessary to ensure the proper functioning of the App and to improve its performance. It will not be combined with other data sources or used for purposes other than those stated.
The lawfulness of the processing of this personal data is based on our legitimate interest as App operators, in accordance with Article 6.1.f) of the GDPR. The legitimate interest pursued is to offer an App free of technical errors, compatible with major devices or operating systems, and user-friendly for our users or customers. We will store this data for 30 days. After this period, it will be automatically deleted.
3.2 Emails
If you contact us via email, we may ask for some personal data in order to respond to your inquiry, complaint, or request. This personal data will mainly include the following:

Any other personal data you choose to provide in the body of the email
The lawfulness of the processing of this personal data is based solely on your consent, in accordance with Article 6.1.a) of the GDPR.

We will store this data until you request its deletion, withdraw your consent, or the purpose for which it was collected expires.
3.3 New User Registration
To register on the App, you must provide a series of personal data, specifically:

Mobile phone number
Before completing the registration process, you must set a password for your account and accept our Terms and Conditions of Use and Contracting as well as our Privacy Policy. You also have the option to register using your credentials from third-party services, such as Google or Apple. In these cases, LetMeCharge will only receive the minimum information necessary to create and authenticate your account, according to the privacy settings you have defined on those services.
The lawfulness of processing this personal data is based solely on your consent, in accordance with Article 6.1.a) of the GDPR.

We will store this data until you request its deletion, withdraw your consent, the purpose for which it was collected expires, or you permanently delete your account.
3.4 Processing of Data for Payment and Billing Management of LetMeCharge Services
To manage the payment and billing of the services offered through the App, it is necessary to collect and process certain personal data linked to your chosen payment method. This data may include, among others, your full name, billing address, and information related to the selected payment method, such as credit card number, PayPal account, or any other payment system enabled by LetMeCharge. The processing of this data is necessary to fulfill the contract between you, as the user, and LetMeCharge, as established in Article 6.1.b) of the GDPR. Payment data may be managed by external payment service providers (e.g., Stripe, PayPal), who will act as data processors and will only use it to securely and efficiently complete the payment process. The Controller guarantees that this data will not be used for any other purpose and will be stored and managed in accordance with the privacy policies of the relevant payment provider. Payment data will be retained for the time necessary to comply with tax and legal obligations arising from the transaction.
3.5 Access to Geolocation Data for Service Delivery
To properly provide some of the services offered through the App, LetMeCharge needs access to your geolocation data. This information is essential for accurately locating your position on the map, identifying nearby electric vehicle charging points, offering navigation instructions to them, and enabling functionalities related to charging, route planning, and in-app payment. The processing of this data is necessary for the performance of the contract between you, as the user, and LetMeCharge, as stated in Article 6.1.b) of the GDPR. Geolocation data may be obtained through internal tools or third-party integrations and may be shared with map and location service providers (such as Google Maps or others) when necessary to enable essential App functionalities. These include real-time location display, locating nearby charging stations, and planning optimal routes. These providers will act as data processors and will only use your data to ensure the correct functioning of these features, in accordance with applicable regulations. Users may disable access to geolocation at any time from their device settings; however, doing so may significantly limit the functionality of the App and the delivery of the service. Geolocation data will be processed anonymously whenever possible and will be retained only as long as strictly necessary to fulfill the purpose for which it was collected.
3.6 Monitoring and Analysis of User Activity in the App
We monitor user activity in the App to identify usage patterns, optimize our services, enhance user experience, and strengthen App security. For this purpose, we may collect and analyze the following types of data:
Browsing and usage data within the App
Technical and connection data from the device
Activity logs
The lawfulness of the processing of this personal data is based on our legitimate interest as App operators, in accordance with Article 6.1.f) of the GDPR. The legitimate interest pursued is to ensure the correct operation and security of the App, as well as to develop improvements and new features focused on the user. We will store this data for 180 days. After this period, it will be automatically deleted, unless it must be retained for a longer period to comply with legal obligations.
3.7 LetMeCharge Care
LetMeCharge Care is an additional subscription-based service available within the App, providing users with personalized assistance in managing and resolving issues related to their electric vehicles. This service includes support for charging point issues and coordination of roadside assistance, acting as an intermediary with the user’s insurance company to facilitate a swift and effective solution. To provide this functionality, LetMeCharge needs to process certain personal data of the user, which may include:

Email address and
Mobile phone number
Name of the insurance company
Insurance policy number
This data will be used exclusively to manage, on behalf of the user, the communication and handling of incidents with their insurance provider or other necessary third parties to resolve the situation. The legal basis for this processing is the performance of the subscription contract for the LetMeCharge Care service, in accordance with Article 6.1.b) of the GDPR. Personal data will be retained only for as long as necessary to manage each incident and while the user maintains an active subscription to the service. Once the subscription ends, the data will be blocked for the periods established by applicable regulations in order to address any potential legal responsibilities.
3.8 Parking and Charging Service (Charge & Park)
The App allows you to automatically access parking spaces in public locations equipped with electric vehicle charging points. This service is provided in collaboration with the company LETMEPARK S.L., with which LetMeCharge has a technological and operational integration agreement. When you access one of these parking facilities, you can park your vehicle, charge it, and leave without needing to carry out any additional procedure, as both the charging process and the corresponding billing are managed automatically through the App. LetMeCharge will only process the data necessary to manage the electric vehicle charging process, including energy consumption and the service fee. In contrast, data related to the use of the parking service—such as the vehicle’s license plate, entry and exit dates and times, and duration of stay—will be processed directly by LETMEPARK S.L., which acts as an independent controller of such data. The processing of this data is necessary to fulfill the contract between you, as a user, and LetMeCharge, pursuant to Article 6.1.b) of the GDPR. LetMeCharge and LETMEPARK S.L. do not share personal data with each other beyond what is strictly necessary to coordinate the proper functioning of the service. 4. RECIPIENTS OF THE DATA AND INTERNATIONAL TRANSFERS
4.1 Data disclosure to third parties
As a general rule, your personal data will not be disclosed or transferred to third parties without your consent, except in the following cases:
When necessary to comply with legal obligations applicable to the Data Controller
When essential for the provision of services contracted through the App, as described in this Privacy Policy
4.2 Data processors
LetMeCharge collaborates with third-party service providers who may have access to your personal data and who will act as data processors. These providers offer services such as technology, logistics, payment processing, data analytics, customer service, marketing, or administrative management, among others. In all cases, the processing of data by these third parties is governed by a contract in accordance with Article 28 of the GDPR, which guarantees a limited use of the data for the purposes indicated by LetMeCharge, as well as appropriate technical and organizational measures to protect the information.
4.3 Specific disclosures associated with third-party services
As part of the services we offer through the LetMeCharge App, it is possible that your personal data may be disclosed to third parties whenever necessary for the proper delivery of the requested services.
Data disclosure to LETMEPARK S.L.: For the management of the parking and charging service, LetMeCharge will share certain personal data with LETMEPARK S.L., which is the data controller for the data related to the use of the parking service. This data includes, among others, your vehicle’s license plate, entry and exit times and dates, and parking duration.
Data disclosure to charging point operators: LetMeCharge may also share some of your personal data with the companies that own the charging points available in the App, in order to facilitate access and use of those charging points. The data that may be shared with these companies includes, among others:
Identification data of your vehicle (such as make, model, and license plate)
Data related to energy consumption and charging duration
Information about the location and usage of the charging point
Client representation: Additionally, LetMeCharge may act on your behalf to facilitate interaction with external service providers, such as the companies responsible for charging points or the entities managing payments. This may involve sharing some of your personal data necessary to carry out this representation, always in accordance with the contract established between LetMeCharge and you.
4.4 Data visible to the User's company or organization
If your user account is linked to a company or organization that uses LetMeCharge to manage the charging of its electric vehicle fleet or to facilitate corporate use of the services offered in the App, certain data related to your activity (such as charging history, location of the charging point, energy consumption, date and time of use, or any other data relevant for operational management) may be visible to the administrators designated by that entity. This access will be strictly limited to the data necessary for the control and management of the services contracted by the organization and will be carried out within the framework of the contractual relationship established between LetMeCharge and the respective company or organization. The processing of this data will always respect the principles of data minimization, confidentiality, and purpose limitation, in accordance with the GDPR.
4.5 International data transfers
No international transfers of personal data are currently foreseen. In the event that LetMeCharge must carry out data transfers outside the European Economic Area (EEA), the appropriate safeguards required by current regulations will be adopted, including standard contractual clauses approved by the European Commission or adequacy decisions. In any case, users will be informed in advance and, if necessary, their explicit consent will be requested.
5. DATA RETENTION
The personal data obtained through the App will be stored within the European Union and will be retained as long as necessary for the purposes described, unless the user requests its deletion. In Section 3 of this Privacy Policy, you can consult the retention periods for each type of processing we carry out through the App.
6. USERS' RIGHTS
As a user of the App, you have the right to:
Access your data: Request access to the personal data we hold about you.
Data rectification: Request the correction of inaccurate or incomplete data we may have about you.
Data erasure: Request the deletion of your personal data when it is no longer necessary for the purposes for which it was collected, or when we no longer have a legal basis to process it.
Restriction of processing: Ask us to restrict the use of your data in certain circumstances, for example:
When you dispute the accuracy of the data, until we verify it
If the processing is unlawful and you prefer restriction over deletion
When we no longer need the data, but you require it for the establishment, exercise, or defense of legal claims
Withdrawal of consent: If you gave us your consent to process your data for a specific purpose, you have the right to withdraw it at any time. You can find information on how to do this in Section 2, where we explain the purposes of data processing.
Objection to processing: When we process your data based on our legitimate interest, you have the right to object to such processing.
Data portability: Request, when technically feasible, that we transfer your personal data to you or to a third party in a structured, commonly used, and machine-readable format.
Lodge a complaint: If you believe your rights have not been respected, you have the right to file a complaint with the relevant supervisory authority, in particular with the Spanish Data Protection Agency (www.aepd.es).

7. SECURITY MEASURES
The Data Controller has implemented appropriate technical and organizational measures to ensure the security of personal data and to prevent its loss, unauthorized access, or misuse.
8. MODIFICATIONS
The Data Controller reserves the right to modify or update this Privacy Policy to reflect legislative or case law changes, or changes in internal personal data processing procedures. Any modifications will be clearly published in the App, along with a clear indication of the date of the update. We recommend users review this Privacy Policy periodically, especially before providing personal information or navigating the App. Regarding data processing carried out prior to the changes to this Policy, the terms in effect at the time the user provided their data will apply, unless legal changes require the new provisions to apply retroactively.
